These terms govern your use of Cafe Vera services

1. Agreement to Terms

By accessing our website, mobile application, using our in-store services, or joining our loyalty program, you agree to be bound by these Terms and Conditions and our Privacy Policy.

If you do not agree to these terms, please do not use our services.

2. About Cafe Vera

Cafe Vera is a cafe business operating in Edinburgh, United Kingdom. We provide:

  • In-store food and beverage services
  • Online account management
  • Loyalty rewards program
  • Customer support services

3. Account Registration & Security

3.1 Account Creation

To use certain features, you must create an account by providing accurate and complete information. You must be at least 13 years old to create an account.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized access.

3.3 Account Suspension

We reserve the right to suspend or terminate accounts that violate these terms, engage in fraudulent activity, or remain inactive for more than 3 years.

4. Loyalty Rewards Program

4.1 Enrollment

Enrollment in our loyalty program is free. You will be assigned a unique member number (e.g., CV-00001) upon registration. New members receive 100 welcome bonus points.

4.2 Earning Points

  • Earn 10 points for every £1 spent (Bronze tier)
  • Higher tiers (Silver, Gold, Platinum) earn multiplied points
  • Points are awarded after successful payment
  • Points may be awarded through special promotions

4.3 Loyalty Tiers

Bronze: 0-4,999 points (1x multiplier)

Silver: 5,000-14,999 points (1.5x multiplier)

Gold: 15,000-29,999 points (2x multiplier)

Platinum: 30,000+ points (3x multiplier)

4.4 Redeeming Points

Points can be redeemed for rewards as specified in our loyalty program. Minimum redemption may apply. Points have no cash value and cannot be transferred or sold.

4.5 Points Expiry

Points remain valid as long as your account is active. Accounts inactive for 3 years may have points expired and account closed. We will send a reminder before expiry if we have your email address.

4.6 Program Changes

We reserve the right to modify the loyalty program, including point values, rewards, and tier thresholds, with 30 days' notice. Existing points will be honored.

4.7 Fraud and Abuse

Any fraudulent activity, manipulation, or abuse of the loyalty program will result in immediate account suspension and forfeiture of all points. We reserve the right to investigate suspicious activity.

5. Orders, Payments & Refunds

5.1 Placing Orders

All orders are subject to acceptance and availability. We reserve the right to refuse or cancel any order. Prices are displayed in GBP (£) and include VAT where applicable.

5.2 Payment

We accept cash, debit cards, and credit cards. Payment is required at the time of order. We use secure payment processors and do not store full card details.

5.3 Refunds

If you are not satisfied with your order, please speak to our staff immediately. Refunds are provided at our discretion for:

  • Incorrect orders
  • Quality issues
  • Service problems

Refund requests must be made on the same day of purchase. Refunds are processed to the original payment method within 5-10 business days.

5.4 Pricing Errors

We strive for accuracy in pricing, but errors may occur. If we discover a pricing error, we will notify you and give you the option to proceed at the correct price or cancel your order.

6. User Conduct & Prohibited Activities

You agree not to:

  • Violate any applicable laws or regulations
  • Impersonate others or provide false information
  • Engage in fraudulent activity or loyalty program abuse
  • Attempt to gain unauthorized access to our systems
  • Use automated systems or bots to access our services
  • Harass, abuse, or harm other customers or staff
  • Interfere with the proper functioning of our services
  • Upload malicious code, viruses, or harmful content

Violation Consequences: Violation of these terms may result in account suspension, termination, loss of loyalty points, and legal action if necessary.

7. Intellectual Property

All content on our website, app, and materials (including text, images, logos, designs, and software) are owned by Cafe Vera or our licensors and are protected by UK and international copyright, trademark, and intellectual property laws.

You may not copy, reproduce, distribute, modify, or create derivative works without our prior written permission.

8. Limitation of Liability

8.1 Service Availability

We strive to provide uninterrupted service but do not guarantee that our website, app, or services will be available at all times. We may suspend services for maintenance or updates.

8.2 Limitation

To the extent permitted by law, Cafe Vera shall not be liable for:

  • Indirect, incidental, or consequential damages
  • Loss of profits, data, or business opportunities
  • Damages arising from unauthorized access or system failures
  • Third-party actions or content

8.3 Consumer Rights

Nothing in these terms excludes or limits our liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded under UK law. Your statutory consumer rights remain unaffected.

8.4 Maximum Liability

Our total liability to you for any claim arising from these terms or our services shall not exceed the amount you have paid us in the 12 months preceding the claim, or £100, whichever is greater.

9. Indemnification

You agree to indemnify, defend, and hold harmless Cafe Vera, its owners, employees, and partners from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your violation of these terms
  • Your use of our services
  • Your violation of any third-party rights
  • Your fraudulent or illegal activities

10. Force Majeure

We shall not be liable for any failure or delay in performing our obligations due to events beyond our reasonable control, including but not limited to acts of God, war, terrorism, pandemic, natural disasters, strikes, power outages, or government actions.

11. Governing Law & Jurisdiction

These Terms and Conditions are governed by and construed in accordance with the laws of England and Wales.

Any disputes arising from these terms or our services shall be subject to the exclusive jurisdiction of the courts of Edinburgh, Scotland.

You may also have rights to bring proceedings in the courts of your country of residence if you are a consumer.

12. Changes to Terms

We may update these Terms and Conditions from time to time. Material changes will be communicated via:

Your continued use of our services after changes take effect constitutes acceptance of the revised terms. If you do not agree, you must stop using our services.

13. Severability

If any provision of these terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

14. Entire Agreement

These Terms and Conditions, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Cafe Vera regarding your use of our services and supersede all prior agreements and understandings.
